Privacy policy and personal data processing
This Privacy and Personal Data Processing Policy (hereinafter referred to as the Privacy Policy) defines the procedure and conditions for processing personal data of users of the mobile application, and establishes requirements for ensuring the security of Users' personal data.
1. General provisions and basic concepts
1.1. This Privacy Policy uses the following terms and abbreviations:
Mobile application - mobile application "Tagam Express", designed for the provision of services.
Operator - Halal food Limited Liability Partnership, registered in accordance with the legislation of the Republic of Kazakhstan.
User - an individual or legal entity using the mobile application.
Personal data - personal data of the User, which the User provides independently during registration or in the process of using the mobile application.
Service(s) — services provided by the Operator.
All other terms and definitions used in this Policy are interpreted in accordance with the current legislation of the Republic of Kazakhstan.
1.2. The processing of personal data in the mobile application is carried out on the basis of:
· The Constitution of the Republic of Kazakhstan;
· Law of the Republic of Kazakhstan "On personal data and their protection";
· Law of the Republic of Kazakhstan "On Informatization";
· Other legal acts of the Republic of Kazakhstan.
1.3. The use of the mobile application by the User means acceptance of this Privacy Policy and the terms of processing of the User's personal data.
1.4. The Privacy Policy applies to all Users and applies to the Personal Data provided by Users during registration and use of the mobile application.
1.5. In case of disagreement with the terms of the Privacy Policy, the User must immediately stop using the mobile application.
1.6. This Privacy Policy applies to the mobile application. The mobile application does not control and is not responsible for the websites of third parties to which the User can follow the links available in the mobile application.
1.7. The mobile application processes personal data, including, but not limited to:
IIN;
BIN;
surname, name, patronymic (if any);
E-mail address;
mobile phone number.
2. Purposes of collection and processing of personal data
2.1. The Operator collects and stores only those Personal Data that are necessary for the provision of Services by the Operator and interaction with the User.
2.2. The User's personal data may be used for the following purposes:
2.2.1. provision by the Operator of Services to the User;
2.2.2. identification of the User;
2.2.3. interaction with the User;
2.2.4. sending promotional materials, information and requests to the User (if necessary);
2.2.5. for other purposes provided for by the Legislation of the Republic of Kazakhstan.
2.3. The user is prohibited from specifying personal data of third parties when registering and using the mobile application.
3. Methods, terms of personal data processing and protection of personal data
3.1. The Operator collects and processes the User's personal data using automation tools.
3.2. The user consents to the processing of personal data without a time limit.
3.3. The Operator takes the necessary organizational and technical measures to ensure the protection, confidentiality, integrity, safety and availability of Users' personal data.
3.4. The Operator respects the rights of the Users of the mobile application in the field of personal data processing, and also complies with other requirements for the processing of personal data established by the legislation of the Republic of Kazakhstan.
3.5. The Operator collects and processes the User's personal data in the manner and with the conditions established by the legislation of the Republic of Kazakhstan.
4. Rights and obligations of Users.
4.1. The user of the mobile application has the right to:
4.1.1. have all the necessary rights that allow him to register and use the mobile application;
4.1.2. use your personal data through any lawful purposes, including for the purposes established by the Policy;
4.1.3. withdrawal of his consent to the collection and processing of personal data by drawing up an appropriate written document, which can be sent to the Operator.
4.2. The user of the mobile application must:
4.2.1. indicate reliable information about yourself to the extent necessary to use the mobile application;
4.2.2. be familiar with this Policy;
4.2.3. update the personal data processed in the mobile application if they change, if the automatic updating of the specified data is not possible;
4.2.4. perform other obligations in the field of personal data, when such obligations arise for the User during the processing of his personal data.
5. Access of third parties to personal data
5.1. The User's personal data may be transferred to a third party in cases provided for by the legislation of the Republic of Kazakhstan.
6. Other provisions
6.1. This Privacy Policy and the relationship between the User and the Operator arising in connection with the application of the Privacy Policy shall be subject to the law of the Republic of Kazakhstan.
6.2. The Operator has the right at any time to change the Privacy Policy (in whole or in part) unilaterally without prior agreement with the User.
All changes take effect from the moment it is posted. The User undertakes to independently monitor changes to the Privacy Policy by reviewing the current version.
6.3. All possible disputes arising from the Privacy Policy are subject to resolution in accordance with the current legislation of the Republic of Kazakhstan at the place of registration of the Operator.
Before applying to the court, the User must comply with the mandatory pre-trial procedure and send the relevant claim to the Operator in writing. The term for responding to a claim is 30 (thirty) calendar days.
6.4. . If, for one reason or another, one or more provisions of the Privacy Policy are found to be invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions of the Privacy Policy.
